MHD3 Files Intent-to-Sue For Jones County, MS Incident

As was stated on our Freedom Watch interview last May and many times since, Jason, Adam and myself are seeking to hold accountable those from the Jones County Sheriff’s Department and the Mississippi Highway Safety Patrol that violated our rights on May 14th.

As such, our awesome legal team recently submitted an intent-to-sue letter to the JCSD, MHSP and the Chancery Clerk of Jones County. I say “intent” because in Mississippi its mandated that those seeking to sue government entities must first inform them of their pending actions and then wait 120 days waiting until actual filing the suit (ostensibly to give the government entity time to review it and decide how to proceed).

Yesterday the Laurel Leader-Call, which serves Jones County and the surrounding area, reported on this legal action and today, issued a more-exhaustive write-up.

To be fully transparent we’ve uploaded the Tort Claim in its entirety which you can view here. At the end you’ll notice Motions to Dismiss for each of us, which are scheduled to be heard on March 8th.

We are confident that justice will prevail.

  1. My only hesitation in this is that if you’re successful, the money will simply be extracted through taxation from the citizens of Jones County, who haven’t done anything wrong. Unfortunately, I don’t see any other way to make this right for you guys.

  3. @Adam. That is true and unfortunate, but ultimately, the citizens of Jones county voted to elect the Sheriff. If they feel some pain from that choice, it’s likely he’ll be getting the pink slip he deserves, come election time.

  4. “a police officer is not a law unto himself, he cannot give an order that has no colorable legal basis and then arrest a person who defies it.” Jones v. State, 798 So 2d 1241, 1247-48 (Miss. 2001) it is a failure to allege an offense cognizable under the laws of the state of mississippi.

    this bloated department should be able to find ways to pay for this particular situation by cutting costs the same way everybody else does, without having to push the costs on to taxpayers. didn’t they just bust a dealer the other day for mississippi’s “new moonshine” (meth) and seized $100,000 in cash?!

    from what i understand, they are overstaffed anyway and doing other agencies jobs for them.

    the only way to affect negative behavior is to hit ‘em in the pocketbook. keep in mind, it looks like this is only for actual and general damages. there may be more coming. punitive damages are intended to reform or deter the defendant and others from engaging in malicious conduct of reckless disregard to plaintiff’s rights and the rights of others.

    to top it off, this is not the only suit that this department is facing, only the most publicized.

  5. @Adam – it’s not immoral to take stolen property from thieves. The property is not owned by the thieves, and stealing is only when one takes property from its unwilling owner. That simply won’t happen if they win.

  7. Not a regular reader but I follow whatever update links I see posted at the Agitator, and I’ve been interested in this saga ever since the first day it started to unfold.

    I dearly hope justice DOES prevail, and that your suit is successful.

    Most counties and cities have insurance that pays off any lawsuits…It is already paid for, nothing will change..

    I would have sued the individuals not the dumb county entity!

    Go, guys! The only way to stop this nonsense is to tag the cops when they do it.
