Report: MHD3 Found Guilty by Jones County Judge David Lyons
We have been contacted by several news sources informing us that a verdict has been reached in our case heard before the Jones County Justice Court on Thursday, September 10th. The crew of the Motorhome Diaries (MHD) and their legal team cannot comment on this until they are officially notified by Judge David Lyons, who heard the case. According to the Laurel Leader-Call:
The Motorhome Diaries trio of Jason Talley, Pete Eyre and Adam Mueller received a guilty verdict from Jones County Justice Court Judge David Lyons Thursday.
and continues:
By phone Thursday, Lyons said the trio were found guilty on their respective charges — Talley, resisting arrest; Eyre, possession of beer in a dry county; and Mueller, disorderly conduct.
“They put up a cash bond, which will be forfeited to cover their fines,” Lyons said. “The balance will be refunded to them.”
According to Motorhome Diaries Website, Talley paid $365, Eyre paid $200 and Mueller paid $215 in charges and fines after their arrest. Eyre noted a “$25 key charge” was added to each person’s fee.
The defendants are also waiting for the Jones County Sheriff’s Department to comply with a request to release any and all communication and documentation related to the May 14th incident. This includes dashboard camera evidence specifically requested by the MHD legal team which Judge Lyons stated he would watch during the two-week break he stated he needed between the trial date and issuing his decision.
The defendants believe this video evidence (if it still exists, unlike the video taken by Adam which was deleted by a member of the Jones County Sheriff’s Department) will show Adam, Jason and Pete complying with all lawful orders and depict three deputies, one sergeant and a captain from the Jones County Sheriff’s Office and an officer of the Mississippi Highway Patrol acting outside the law.

they need to install some hidden and some visible cameras in the marv and post signs at the door that way if the police delete the video they might not find it all. and with the sign at the door it should be legal to record in all 50 states.
Well that’s freaking rotten news. I know you have to keep quiet about it now, so I’ll just look forward to new developments.
wait. lyons ruled without seeing the footage he said he needed to see before ruling? i’m confused by this…
@nikki: I assume the judge and the prosecuting attorney saw the footage but I don’t know this for sure, especially since the Jones County Sheriff’s Department has a habit of deleting video evidence. I do know that neither we nor our attorney’s were able to view this video.
We will be able to post more once we get an official notice by the judge.

The only surprising thing about the ruling is that the judge took two weeks rubber stamp the police and prosecutors contentions. Normally the rubber stamp happens right away.
The police and court systems at all levels in this country are broken… and there really isn’t any fixing it without completely tossing out every idiot that is part of it and starting over.

i live in jones county and i know exactly how you feel about the sheriffs and the judges, i was pulled over for goin 40 in a school zone but by my cell phone it said 435 and the school zone id from 230-430, well a sheriff pulled me over and said he clocked me a 41 just so it would be reckless driving and i got a noise ordinance because the sheriff said my subs were to loud, the best part is they werent hooked up so there is no possible way he could have heard them, he just saw them in the back when he looked in the window. i got a $350 fine for the noise and i have court on the 5th for the “reckless” driving.
Verdicts like bank failures come on Fridays.
You should have already filed suit under 42USC1983. You have much better evidentiary powers under federal civil law than any other.
Asinine ruling. Inane ruling. Good ole boys are happy as clams. Don’t let them get away with this! Appeal!
….and what about the money it took to repair your motorhome after the JCSD ransacked it and tore it to pieces. They should have to reimburse you for those expenses….they had no warrant, no right to do that, no reason to do that. They were looking for something to justify what they had already done. As for possession of one unopened beer in a refridgerator….that is not against the law by any standards. According to your own attys, this charge was not even legal to be a charge. What gives with that!? I hope your attys get the lead out and get busy and show these guys a thing or two about law…..that it isn’t a game to be played but instead something to be upheld to the highest degree. When this happens to one American, it happens to us all. Hopefully, your legal team will be able to get in there and get the law heard and respected.
Unreal dudes. I guess they just can’t have you celebrating any kind of victory. It might undermine their power. They really ARE the law in JC. Keep standing up for your rights!

Don’t be too hard on what passes for judicial proceedings in jones County. The very same thing happens all over the US south. The idea of actual justice down there died many years a go while slavery was still in style and has never been revived. Count yourself lucky that the so called “judge” didn’t throw you behind bars for a dozen years. The best thing you can do is make sure as many people as possible hear about this miscarriage of justice and refrain from travelling in such repressive areas of the country. After all why put yourselves in the cluthches of such regressive imbeciles?
The government thugs were in a catch-22. If the initial verdict was innocent, it would have been an admission that they screwed up. On the other hand, the guilty verdicts enable an appeal and outside scrutiny on the erasure of the video and the state’s refusal to share their docs and vids with the defense.
Memo to Sheriff Hodge and his merry band of armed bureaucrats:

I wonder if a FOIA request on Jone’s County’s asset forfeiture practices would turn up some interesting tidbits.

Beware as I read Title 42 1983 you have to prove a pattern of civil rights violations and if you don’t prevail you pay the bastards’ legal fees.
That is ridiculous! All these people are doing is proving every libertarians point that change is needed…. So is alcohol illegal in a dry county? Nobody is aloud to drink there orrrr what?
SOmeone help me out here. How is it that a Judge can anounce a verdict like this? Doesn’t it have to be done in open court before the parties to the case?
Whatever came of the efforts to recover the deleted video? I remember hearing something about that back in May when this all went down.

Are you seriously implying that this wouldn’t happen in the “enlightened” North? I’d like to introduce you to some police officers in Philadelphia.
There are numerous programs that could salvage that video, provided you didn’t go and record more footage on the disk.
Invid: I agree; North or South, all over America the age-old job of the “highwayman” is now a government gig. In fact, for some small cities and counties, the highway ‘patrol’ brings in the majority of their revenues each year…so giving tickets for every conceivable “violation” is a matter of paying the bills.
In ancient times they hid beside well-traveled roads with a club or a knife; today they drive cruisers with lights on the roof, and wear cool shades.
Like we didn’t see that coming. The Judge is between a rock and a hard place. If he finds the 4th amendment was violated, all his buddies on the police force get in trouble. He knows it will be appealed, and simply kicked it down the line, so the cops in Jones County won’t pepper spray him.
Constitution? We don’t need no stinkin Constitution! We got Badges!
This is the same way all over our nation. Its not a “southern” thing so lets not all jump on the bandwagon with these racial remarks. The race issue is over and done with in the south as much as anywhere in the nation so lets not play the “race card” here. The facts of this case are simple. The Sheriffs officers did what they normally do by acting is if they were gods. Instead of issuing a citation for the improper tag or whatever, they just had to prove that they were the bosses. This is a normal reaction with this agency. From the supervisor to the judge to the sheriff and then his deputies down to the dispatch officers. They push and shove their way around down here because many of our citizens are ignorant of their rights as Americans. What I say to you guys is DO NOT STOP> IF YOU QUIT ON THIS THEN YOU`RE NO BETTER THAN ANYONE ELSE AND ALL OF THIS PUBLICITY WILL ONLY BE SEEN AS A WAY FOR YOU GUYS TO USE THIS SITUATION AS A BENEFIT FOR YOU BY GETTING SOME FREE ADVERTISING.
this crap happens NATIONWIDE! i live in mississippi and for one know better than to have alcohol in a motor vehicle ANYWHERE in the nation not just MISSISSIPPI. i also used to own a trucking company and saw this hapeen to my drivers more in minn, mich and pennsylvania a lot more than in the south. DONT PROFILE
technically that RV was your home. Cops need a search warrant to search your home. So in addition to all the other bullshit they did, they violated your fourth amendment rights. Just thought id throw that out there.
